What is Spam?

Spam refers to any unsolicited email sent to individuals who have not given explicit permission to receive such emails on the specific topic of the communication.

Permission-Based Email Marketing

To send emails using Mediainfini, you must have the recipient’s permission, which can be obtained through:

1. Email Newsletter Subscription: Individuals who voluntarily subscribe to your email newsletter through a sign-up form on your website.

2. Opt-In Checkbox: If you use an opt-in checkbox on a form, it must not be pre-selected. The person filling out the form must willingly select the checkbox to indicate their consent to receive email communications.

3. Offline Form Consent: If individuals provide their email address through offline forms such as surveys or competitions, you can only contact them if it was clearly explained to them that they would receive email communications and they explicitly consented by ticking a checkbox.

4. Recent Customers: Customers who have made a purchase from you within the last 2 years may be contacted via email, as long as they were informed about potential email communications at the time of purchase.

Prohibited Email Addresses

You are strictly prohibited from importing or sending emails to the following types of email addresses:

1. Lack of Explicit Permission: Email addresses for which you do not have explicit, provable permission to contact regarding the specific topic of the email you are sending.

2. Third-Party Acquired Lists: Email addresses that have been bought, loaned, rented, or obtained in any way from a third party, regardless of any claims made about the quality or permission.

3. Inactive Contacts: Email addresses of individuals with whom you have not had email contact in the last 2 years. Permission does not remain valid indefinitely, and these individuals may have changed their email addresses or may not recall providing permission.

4. Scraped or Copied Email Addresses: Email addresses obtained by scraping or copying from websites. Simply because individuals publish their email addresses does not imply consent to receive communications.

Email Content Requirements

Every email sent through Mediainfini must comply with the following requirements:

1. Unsubscribe Option: Each email must include a single-click unsubscribe link that allows recipients to instantly remove themselves from your mailing list. Once unsubscribed, you are prohibited from sending any further emails to those individuals.

Account Suspension and Termination

We reserve the right to suspend your account immediately and initiate an investigation into your activities if your campaigns generate a high percentage of spam complaints (more than 0.1%), bounce rates (more than 20%), or very low open rates (less than 5%). If it is determined that you have been sending emails without proper permission, your account will be terminated.

We may request proof of permission from your recipients, and failure to provide such proof may result in account closure. Alternatively, if you can demonstrate permission, we will reactivate your account, allowing you to continue using our services.
